By accessing wisensellc.com or using any WiSense LLC product, you agree to these Terms of Service. If you do not agree, do not use our services.
2. Use of Our Services
You may use our services for lawful purposes only. You agree not to: interfere with or disrupt the operation of our services; attempt to gain unauthorized access to any system or data; use our services to transmit spam, malware, or harmful content; or violate any applicable local, state, national, or international law.
We reserve the right to suspend or terminate access for any user who violates these terms.
3. Accounts
Some of our products require you to create an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at nicholaswittle@wisensellc.com if you suspect unauthorized access.
4. Affiliate Links and Third-Party Services
Our products, including Horizon, contain links to third-party services (such as Viator, Klook, and others). We may earn a commission when you make a purchase through one of these links at no additional cost to you.
WiSense LLC is not a party to any transaction you complete on a third-party platform. We do not guarantee the accuracy, availability, or quality of third-party listings, prices, or services. Any dispute arising from a third-party transaction must be resolved directly with that provider.
5. Intellectual Property
All content on wisensellc.com — including text, design, code, logos, and product names — is the property of WiSense LLC or its licensors and is protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works from any WiSense content without express written permission.
6. Disclaimer of Warranties
Our services are provided "as is" and "as available" without warranty of any kind, express or implied. WiSense LLC does not warrant that the services will be uninterrupted, error-free, or free of viruses or other harmful components.
Travel information displayed in our products — including flight prices, hotel availability, car rental rates, and experience listings — is sourced from third-party APIs and may not be accurate or current. Always verify booking details directly with the provider before completing a purchase.
7. Limitation of Liability
To the maximum extent permitted by law, WiSense LLC and its founder shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, our services — even if WiSense has been advised of the possibility of such damages.
Our total liability to you for any claim arising from these terms or your use of our services shall not exceed the amount you paid WiSense LLC in the twelve months preceding the claim, or $100, whichever is greater.
8. Indemnification
You agree to indemnify and hold harmless WiSense LLC and its founder from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of our services or your violation of these terms.
9. Governing Law
These terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law provisions. Any dispute arising under these terms shall be resolved exclusively in the state or federal courts located in Pennsylvania.
10. Changes to These Terms
We may update these terms at any time. When we do, we will update the effective date below. Continued use of our services after a change constitutes acceptance of the revised terms.

12. SMS Messaging Terms
WiSense LLC operates an SMS program for Apex, our restaurant workforce and order management application. The program sends transactional operational alerts only: notifications of new online orders, reminders when an order is left unattended, shift coverage requests when an employee calls out, and support escalations raised by a venue manager. The program never sends marketing or promotional content.
Messages go to the owners, managers, and staff of subscribing restaurants, and to WiSense LLC support personnel. Consent is given inside the Apex application: an authorized manager of the venue enables "Staff SMS on new orders" in the venue's order alert settings and enters a mobile number. The consent text shown beneath that field reads: "By saving a number with alerts on, you agree to receive transactional SMS about orders, shift coverage and support for this venue. Message and data rates may apply. Reply STOP to any message to opt out, HELP for help."
Message frequency varies based on order volume and shift activity at the venue.

Mobile carriers are not liable for delayed or undelivered messages.
